Terms of Use

These are the rules for using Cally Desk. We've tried to write them clearly. The short version: use the service for legitimate business purposes, pay on time, and don't do anything illegal with it.
1. Acceptance of Terms
By accessing or using Cally Desk, you agree to be bound by these terms and our Privacy Policy.
2. Description of Service
Cally Desk provides AI-powered receptionist, chat widget, booking, and website services for small businesses on a subscription basis.
3. Account Registration
You must be 18 or older to register. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials.
4. Subscription and Payment
Subscriptions are billed monthly or annually. All subscriptions auto-renew. We will provide at least 30 days' notice of any price change before it takes effect for your account.
5. Free Trial
New customers receive a 14-day free trial. After the trial, your selected plan begins automatically unless you cancel before the trial ends.
6. Acceptable Use
You agree not to use Cally Desk for unlawful, harmful, or abusive purposes, including unsolicited bulk calling (spam), harassment, or any activity that violates applicable telecommunications law.
7. AI and Call Recording Compliance
You are responsible for complying with local recording laws in your jurisdiction. Some U.S. states are one-party consent (recording is permitted with one party's consent), while others (e.g., California, Florida, Pennsylvania) require all-party consent. You must provide appropriate disclosures to callers as required by law.
8. Intellectual Property
Cally Desk owns the platform, software, and underlying technology. You retain ownership of your business data, content, and recordings.
9. Limitation of Liability
To the maximum extent permitted by law, Cally Desk's total liability for any claim arising out of or related to these terms is limited to the amounts paid by you in the 12 months preceding the claim.
10. Termination
You may cancel your subscription at any time from your dashboard. We may suspend or terminate accounts that violate these terms, with notice where reasonably possible.
11. Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles.
12. Changes to Terms
We may update these terms. Material changes will be communicated by email at least 30 days before they take effect.
